Excerpt: ... Commonwealth vs. Lypson Larceny as agent--Section 107 of the Act of 1860--Indictment--Duplicity. Section 107 of the act of 1860 provides that every person in the employ of another, receiving any money of his employer and embezzling it shall be guilty of larcency. The act permits three counts in an indictment charging three distinct felonies. Motion for new trial, No. 791 June Sess. 1916. R. A. Freiler and M. J. Ryan, for motion. M. F. Duffy and Roy P. Hicks, contra. KOCH, J. Nov. 13, 1916. The indictment contains three counts, the first of which charges, that Anthony Lypson on the 29th day of July, A. D., 1914 being a servant in the employ of A. J. Smith, a merchant, by virtue of such employment then and there did receive and take into his possession money, to wit, the sum of Five and Forty-five One Hundredths ($5.45) Dollars, current money of the United States, the subject of larcency, a more particular description whereof is to the jurors unknown, for and in the name and on account of his master and employer and then and there fraudulently and felonously did take, steal, carry away, embezzle and convert the same to his own use, contrary etc. The second count charges a similar offence with reference to Seventy-two Dollars and Ninety cents ($72.90) on the 2nd day of September, 1915, and the third count charges another like offence with reference to Eighty-seven Dollars and Twenty-five cents ($87.25) on the 23rd day of December, 1915. When the defendant was called for trial he moved to quash the indictment on the ground of duplicity, alleging that more than one distinct felony cannot be charged in the bill of indictment.
