[SR: 4274818], Hardcover, [EAN: 9780742551442], Rowman & Littlefield Publishers, Rowman & Littlefield Publishers, Book, [PU: Rowman & Littlefield Publishers], Rowman & Littlefield Publishers, In Confirmation Wars, Benjamin Wittes rejects the parodies offered by both the Right and Left of the decline of the process by which the United States Senate confirms―or rejects―the president's nominees to the federal judiciary. He draws on original reporting and new historical research to provide a more accurate understanding of the current climate. He argues that the transformations the process has undergone should not be understood principally in partisan terms but as an institutional response on the part of the legislative branch to the growth of judicial power in the past five decades. While some change may have been inevitable, the increasing aggressiveness of the Senate's conception of its function poses significant challenges for maintaining independent courts over the long term. The problem, Wittes argues, lies both in the extortionate quality of modern confirmations, in which senators make their votes contingent on reassurance by the nominees about substantive areas of concern, and in the possibility that the breakdown of the confirmation process represents a far larger effort by the Senate to rein in judicial power. Wittes offers several strategies for managing the political conflict surrounding nominations, strategies that seek to protect the independence of the courts and the prerogative of the president to choose judges while maximizing the utility to democratic government of a Senate that takes its advice and consent role seriously. Most importantly, Wittes argues for ending the relatively new practice of having nominees testify before the Senate Judiciary Committee.Published in cooperation with the Hoover Inst, 10832, Courts, 173490, Rules & Procedures, 10777, Law, 1000, Subjects, 283155, Books, 11086, History & Theory, 16022621, Political Science, 5571255011, Politics & Government, 3377866011, Politics & Social Sciences, 1000, Subjects, 283155, Books, 10757, Legislative Branch, 16023071, United States, 5571255011, Politics & Government, 3377866011, Politics & Social Sciences, 1000, Subjects, 283155, Books, 271629011, Judicial Branch, 16023071, United States, 5571255011, Politics & Government, 3377866011, Politics & Social Sciences, 1000, Subjects, 283155, Books, 5571275011, Public Affairs & Policy, 5571276011, City Planning & Urban Development, 16022981, Communication Policy, 5571277011, Cultural Policy, 5571278011, Economic Policy, 5571280011, Environmental Policy, 5571279011, Intergovernmental Organizations, 5571281011, Non-Governmental Organizations, 10767, Public Affairs & Administration, 11113, Regional Planning, 10771, Social Policy, 11115, Social Security, 10580, Social Services & Welfare, 5571255011, Politics & Government, 3377866011, Politics & Social Sciences, 1000, Subjects, 283155, Books, 468222, Law, 491506, Business Law, 491510, Constitutional Law, 491512, Criminal Law, 491516, Legal Reference, 491514, Tax Law, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books, 491472, Political History, 491464, Political Science, 468214, Social Sciences, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books, 491474, Public Policy, 491464, Political Science, 468214, Social Sciences, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books, 684293011, Government, 491464, Political Science, 468214, Social Sciences, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books

[ED: Hardcover], [PU: ROWMAN & LITTLEFIELD PUBL GROU], In Confirmation Wars, Benjamin Wittes examines the degradation of the judicial nominations process over the past fifty years. Drawing on years of reporting on judicial nominations, including numerous interviews with nominees and sitting judges, he explains how the process has changed and how these changes threaten the independence of the courts. Getting beyond the partisan blame game that dominates most discussion of nominations, he argues that the process has changed as an institutional response by Congress to modern judicial power and urges basic reforms to better insulate the judiciary from the nastiness of contemporary politics.
