Excerpt: ...the priest-confessor as a judge seated in a tribunal, pronouncing sentence without appeal upon the sinner, sending him away absolved, or retaining him in the fetters of sin by refusing absolution. But was it always thus from the days of the apostles? I have shown that for many centuries sinners were wont to confess their sins in the presence of the particular church of which they were members, and that this confession at first had special reference to a relapse into idolatry and some other heinous sins. It was also by the decision of this same church that they were restored to communion. Ecc. Hist. Paris, Nivelle, 1567, book xii, ch. xxviii., p. 326. But what were the customs introduced when, at first, in certain cases, and afterwards generally, private was substituted for public confession; and how was it practised? A Penitential, composed by John, surnamed the Faster, bishop of Constantinople, who died A.d. 596; and referred to by Grand Colas, doctor of Sorbonne, in his Ancient Sacramentary furnishes us, I believe, with the earliest information we can have on this subject. The author of this Penitential represents the priest and the penitent as both standing, one at one corner of the altar, the other at the other. When they are thus placed the priest questions the penitent. Egbert, bishop of York, A.d. 735, likewise prepared a Penitential, which is also quoted by Grand Colas, according to which the penitent was to make his confession standing. According to the Roman order, the penitent bends humbly before tbe priest, who, after having recited a prayer, makes him rise and sit near him; then he speaks to him of his sins.f This book, whose author is unknown, but which has been an authority in matters of liturgy for a long time, was apparently...
