The old jurisprudence considered corporations incapable of been prosecuted, however, the growing reach of corporations and their effect on society as well as growing corporate crimes have made it pertinent for the legal systems to initiate criminal prosecution against the mind behind the corporate crime and this has led slowly the courts around the world to developed important theories in order to hold corporations liable for their acts, omissions and forbearance. Cardozo asked in The Nature of the Judicial Process. His answer made it clear that he accepted the view, controversial at the time, that judges did not 'find' a preexisting law, but rather 'made' the law. At the same time, Cardozo argued, judges were not free to make law as they pleased or 'travel beyond the walls of the interstices, the bounds set to judicial innovation by precedent and custom'. Judges must draw their inspiration from 'consecrated principles', he asserted, and not yield to a 'vague and unregulated benevolence'" (ANB)."Cardozo presented a strikingly modern interpretation of judicial decision making that radically subverted the conventional understanding. Yet his presentation was so adroit, balanced, and elegantly fashioned that potential critics were generally disarmed" (Polenberg, p. 86).Cardozo's principles, a basis for what is now referred to as judicial activism, were applied when he served on the Supreme Court in the 1930s, part of the smaller liberal bloc supporting President Roosevelt's New Deal legislation, against conservative claims that they were unconstitutional. This book is Fine or better, tight, square, sharp-cornered and with zero markings or flaws. Stated 9th printing on copyright page, September, 1937. Uncut page edges. Unclipped cream colored Dust Jacket shows original price of $1.75. Attractive black border design on front with list of contents, title, author etc. and same on spine, but spine is slightly yellowed. Some minor scuffing to top of rear, small 1/8" tear at top and bottom of spine, and some minor rubbing of the paper at bottom corner of the rear. See photos. Fantastic copy of this scarce book, particularly rare with the DJ in this condition. This is Justice Cardozo's most important and most influential work and a classic in the law. Cardozo served on the US Supreme Court, replacing Oliver Wendell Holmes, appointed by President Herbert Hoover in 1932 and serving until his death in 1938. He formed part of the liberal bloc of justices known as the Three Musketeers. Cardozo sought to modernize law by making it more responsive to social change through judicial discretion. He tried to strike an appropriate balance between continuity in the law and judicial creativity.
